Disclosing to Patients Other Offices where they may Obtain Advanced Imaging Services
As a result of the Centers for Medicare and Medicaid Service's (CMS) implementation of a provision in the Affordable Care Act (ACA), starting January 1, 2011, referring physicians are required to disclose to their patients in writing that they may obtain certain advanced imaging services (CT, MRI, PET) at other locations within a 25 mile radius of the place of the referral.
The Academy has compiled downloadable forms for your use to comply with this new requirement. The following is a brief notice to members who are choosing to obtain and use these sample notice forms:
- The notice is to be given to patients in writing at the time of the referral, but a signature is not required.
- If the referral is made by phone the written notice must be provided (mail or email is acceptable).
- There should be documentation that the notice has been given to the patient, whether in person or by mail/email.
- Written notice is to be given EACH time there is a CT, MRI, or PET scan referral, even if a prior disclosure was made to that patient.
- Hospitals are not included within the definition of 'supplier'; therefore they may be included in the notice, however hospitals are not counted in determining whether at least five suppliers are listed.
- The notice should be updated annually.
