New Jersey Legislation to Fix Statute on NCV Studies

In 2006, the AAN supported New Jersey Assembly Bill 456, which sought to define needle electromyography (EMG) and the interpretation of nerve conduction velocity (NCV) studies as the practice of medicine in the state of New Jersey. Prior to final passage, however, the language was changed without the AAN's knowledge or support. The bill, as signed into law, defines performing needle EMG as well as the interpretation and performance NCV studies as the practice of medicine. New Jersey statue (P.L.2005, c.303) prevents technicians from legally performing NCV studies.

Current Assembly Bill 2357 and Senate Bill 1305 would undo this limitation by removing the stipulation that only a licensed physician may perform NCV studies. This modification would restore the intent of the original bill and allow New Jersey physicians to resume the standard practice of interpreting NVC studies conducted by technicians. On June 5, SB 1305 received unanimous approval in the Senate Health, Human Services and Senior Citizens Committee.
